Banks, electricity distribution companies, municipal licensing departments and factory inspectors often ask for a 'Pollution NOC' from the State Pollution Control Board before they will release a loan, sanction a power connection or issue a trade or factory licence. Depending on your activity this is a White-category acknowledgement, a consent-exemption certificate or a specific no-objection letter. We identify which document you actually need and obtain it.

Legal basis: Water (Prevention and Control of Pollution) Act, 1974; Air (Prevention and Control of Pollution) Act, 1981; CPCB directions of 2016 on categorisation of industrial sectors (Red / Orange / Green / White)

Who needs it

  • White-category units (assembly, packaging, software, certain workshops) that need a formal SPCB acknowledgement in lieu of consent
  • MSMEs applying for bank finance, PMEGP or state subsidy schemes that list a Pollution NOC as a pre-condition
  • Units applying for a new or enhanced electricity connection where the DISCOM asks for SPCB clearance
  • Businesses seeking a municipal trade licence, FSSAI licence or Factories Act licence that requires an SPCB no-objection
  • Service establishments — restaurants, hotels, diagnostic labs, warehouses — unsure whether they fall under consent at all

How we get it done

  1. 1

    Activity classification

    Day 1–2

We map your activity to the CPCB sector list to determine whether you are White category (NOC / acknowledgement), exempt, or actually need a CTE / CTO.

  2. 2

    Application drafting

    Day 3–5

The correct form — White-category intimation, exemption request or specific no-objection application — is prepared with supporting documents.

  3. 3

    Filing and follow-up

    Day 6–20

The application is filed online or at the Regional Office and we follow up with the concerned officer until the acknowledgement or letter is issued.

  4. 4

    Delivery to the requesting authority

    Day 20–30

We hand you the NOC in the format the bank, DISCOM or licensing body expects and confirm nothing further is needed from the SPCB.

If you don’t comply

Running a consent-category activity under the belief that only an NOC is needed is a common and costly mistake — it is treated as operating without consent under the Water and Air Acts, exposing you to closure, Environmental Compensation and penalties of ₹10,000 up to ₹15 lakh under the amended Acts. Misdeclaring your category to obtain a White-category acknowledgement can lead to its cancellation and prosecution.

Frequently asked questions

Is a Pollution NOC the same as Consent to Operate?

No. 'Pollution NOC' is a colloquial term. For White-category units the Board issues an acknowledgement or NOC because they are exempt from consent; for every other category the actual legal document is a Consent to Establish or Consent to Operate. We tell you upfront which one applies so you do not apply for the wrong thing.

Which activities fall in the White category?

CPCB's 2016 categorisation lists around three dozen low-polluting sectors — for example assembly of air coolers and electronic items, bakeries below a certain capacity, cotton and woollen hosiery without dyeing, and solar module assembly. The list is applied with state-level nuances, so we confirm your fit before filing.

Can the SPCB refuse an NOC?

Yes, if your activity is actually a consent category, if the premises are in a non-conforming zone, or if the application is incomplete. A refusal with reasons is useful information — it tells us the proper route, usually a CTE application, which we can then file.

How long does a Pollution NOC take?

White-category acknowledgements are often issued within one to three weeks because there is no inspection. Specific no-objection letters that require Regional Office review can take four to six weeks depending on the state.
