Consent to Operate (CTO)

Start production with a valid CTO — and conditions you can actually comply with.

Professional fee
From ₹20,000
Govt. fees extra
Turnaround
30–90 days
Working days, typical
Authority
State Pollution Control Board (SPCB) / Pollution Control Committee (PCC)
Validity
Red category: typically up to 5 years; Orange: up to 10 years; Green: up to 15 years (varies by state). White category needs only intimation.

Consent to Operate is the SPCB's permission to run your plant, discharge treated effluent and emit through approved stacks. It also fixes the production capacity, fuel, water use and monitoring conditions you will be held to. We prepare the application, get your monitoring done by recognised labs and manage the inspection so production starts on schedule.

Legal basis: Section 25/26 of the Water (Prevention and Control of Pollution) Act, 1974 and Section 21 of the Air (Prevention and Control of Pollution) Act, 1981; CPCB categorisation guidelines (Red / Orange / Green / White)

Who needs it

  • Every unit holding a CTE that is ready to begin trial runs or commercial production
  • Units whose CTO has expired or whose capacity, products or fuel have changed since the last consent
  • Hospitals, hotels, educational campuses and commercial complexes with STPs or DG sets above the state threshold
  • Units generating hazardous waste — in most states the CTO application doubles as the Hazardous Waste Authorisation application
  • Businesses acquiring an existing plant that need the consent transferred into their name

Documents required

  1. 1Copy of the Consent to Establish and a point-wise compliance report against its conditions
  2. 2Updated process flow diagram and actual installed capacity of each product line
  3. 3Photographs and technical details of installed ETP/STP, air pollution control devices and stack heights
  4. 4Stack emission, effluent, ambient air and noise monitoring reports from an MoEFCC-recognised / NABL-accredited laboratory

How we get it done

  1. 1

    Readiness check

    Day 1–5

We walk the plant against the CTE conditions, identify anything the inspecting officer will flag — missing stack ports, unlabelled hazardous waste storage, unlined drains — and give you a fix list.

  2. 2

    Monitoring and documentation

    Day 6–15

Baseline stack, effluent and ambient monitoring is scheduled with a recognised lab and the compliance report, water balance and hazardous waste inventory are drafted.

  3. 3

    Online application and fee

    Day 16–18

The CTO application (combined with Hazardous Waste Authorisation where the state uses a single form) is filed on the state portal with all annexures and the fee for the chosen validity period.

  4. 4

    Inspection support

    Day 19–50

We accompany the Regional Office inspection, present the file and respond in writing to any observations within the stipulated time.

  5. 5

    Grant and compliance calendar

    Day 50–90

On grant we convert the CTO conditions into a monitoring and reporting calendar — monthly or quarterly sampling, Form V, hazardous waste returns — so renewal is smooth.

If you don’t comply

Operating without a valid CTO invites closure directions and disconnection of electricity and water under Section 33A of the Water Act and Section 31A of the Air Act, Environmental Compensation assessed by the SPCB for the period of violation, and statutory penalties of ₹10,000 up to ₹15 lakh (with daily penalties for continuing default) under the Water and Air Acts as amended in 2023–2024. NGT orders have frequently upheld compensation running into lakhs for units found operating without consent.

Why MYDA Group

Frequently asked questions

Can I start trial production before the CTO is granted?

Some SPCBs allow a short trial run after CTE compliance is verified, but commercial production before CTO is a clear violation. Where a trial run is needed to generate monitoring data, we seek written permission from the Board first rather than relying on an assumption.

How long is a CTO valid and can I pay for a longer period?

Validity depends on your category — commonly up to 5 years for Red, 10 for Orange and 15 for Green, though several states cap it lower. Most Boards let you pay consent fees for multiple years upfront, which saves repeated renewal effort.

Is Hazardous Waste Authorisation separate from CTO?

Legally they are separate approvals under different rules, but most states have integrated the application so one filing yields both the CTO and the authorisation under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. We make sure the hazardous waste schedule in your CTO application is complete so the authorisation is not held back.

What happens if we exceed the consented production capacity?

Producing beyond the consented capacity is treated as operating without consent for the excess quantity and is a common ground for Environmental Compensation. If demand is growing, apply for an amended CTO before you cross the limit — we can usually file an amendment faster than a fresh application.

Which lab reports does the SPCB accept?

Boards accept analysis from laboratories recognised by MoEFCC under the Environment (Protection) Act or accredited by NABL for the relevant parameters. Reports from unrecognised labs are rejected, so we coordinate sampling only with labs on the accepted list in your state.
