Environment, health and safety obligations in India are spread across central acts, state rules, consent conditions and licences from several regulators. Our EHS compliance audit builds a complete legal register for your operations, verifies compliance for each requirement through documents and site inspection, and gives management a scored dashboard with corrective actions — the same lens a buyer, lender or regulator would apply.

Legal basis: Environment (Protection) Act, 1986 and rules (HOWM 2016, PWM 2016, EWM 2022, BMW 2016, SWM 2016, Noise Rules 2000); Water Act, 1974; Air Act, 1981; Factories Act, 1948 and State Factories Rules; Manufacture, Storage and Import of Hazardous Chemical Rules, 1989; Petroleum Act, 1934 and PESO rules; Public Liability Insurance Act, 1991; CGWA guidelines

Who needs it

  • Manufacturing plants with multiple licences — consents, factory licence, PESO licences, boiler certificates, hazardous waste authorization — and no single owner tracking them
  • Companies preparing for customer audits (automotive OEMs, pharma MNCs, apparel brands) that include EHS legal compliance
  • Groups acquiring or integrating new plants that need a consistent compliance baseline
  • Boards and audit committees seeking assurance on EHS legal risk as part of ERM or BRSR governance
  • Units handling hazardous chemicals above MSIHC threshold quantities requiring safety reports and on-site emergency plans
  • Hospitals, labs and healthcare facilities with bio-medical waste, radiation and fire compliance obligations

How we get it done

  1. 1

    Legal register development

    Week 1–2

We identify every act, rule, notification, consent condition and licence that applies to your operations and translate them into specific, auditable requirements.

  2. 2

    On-site verification

    Week 2–3

A multi-disciplinary team audits the site over one to three days, checking documents, interviewing personnel and physically inspecting process areas, utilities, storage and waste facilities.

  3. 3

    Scoring and risk rating

    Week 3

Each requirement is scored as compliant, partially compliant or non-compliant, with risk ratings based on legal consequence and likelihood of enforcement.

  4. 4

    Report and management presentation

    Week 3–4

The report includes a compliance dashboard, detailed findings with photographs and legal references, and a corrective action plan presented to plant and corporate management.

If you don’t comply

EHS non-compliance carries layered consequences: prosecution under Section 15 of the Environment (Protection) Act (imprisonment up to 5 years), closure directions under Section 33A of the Water Act and Section 31A of the Air Act, prosecution of the occupier and manager under Sections 92–96 of the Factories Act, and personal liability of directors for offences by companies. The commercial exposure — lost orders after a failed customer audit, insurance disputes and valuation haircuts in transactions — is often larger than the statutory penalty.

Frequently asked questions

How is an EHS compliance audit different from an environmental audit?

An environmental audit focuses on pollution-control performance and the Form V statement. An EHS compliance audit is wider: it covers environment, occupational health and safety, hazardous chemicals, fire and statutory licences across all regulators, and it is organised around a legal register so that nothing applicable is missed. Many clients do both — the environmental audit annually and the EHS audit before renewals, transactions or customer audits.

What is a legal register and why do we need one?

A legal register is the master list of every legal requirement that applies to your site, with the specific obligation, frequency, evidence and owner. ISO 14001 and ISO 45001 require you to identify and have access to compliance obligations, and most customer audit protocols ask for it. Without one, compliance depends on individual memory and the regulator's notice.

How long is the site visit and who needs to be available?

Typically one to three days depending on plant size and complexity. We need access to the EHS manager, plant head, maintenance and stores in-charges and HR for labour-related records, plus escorted access to all areas including utilities, ETP and waste storage.

Will the report be shared with any regulator?

No. The audit is a confidential advisory engagement for your management. We recommend addressing the findings promptly, however, because the same conditions are visible to inspectors and the report could be discoverable in litigation or due diligence.
